In U.S. v. Zachary Babitz, Cr. 24-1284 (DNM) the defense filed a Motion for Immediate Stay of Proceedings, which can be found here. This case was authorized on 10/22/25 (DE 92). The team had been invited to a DOJ meeting on 7/14/25, but the meeting was canceled by DOJ and not held.
In U.S. v. Fawaz Ahemeid, Cr. 20-502 (EDNY) (a prior Garland no seek pending reconsideration by Bondi DOJ), the defense seeks a stay of matters requiring travel outside of the United States by defense counsel or those acting on counsels’ behalf, as well as the use of service providers for whom expenses and/or associated service fees would need to be advanced.
A Notice of Intent was filed in U.S. v. Antwan Hue, Cr. 24-38 (EDVA), DE 223, making this the third NOI filed in the last three days, see here. The DOJ meeting was September 9, 2025, and a reconsideration of a prior Garland no seek.
A Notice of Intent was filed in U.S. v. Kalif Cox, Cr. 25-91 (SDNY) , after a DOJ meeting on July 2, 2025. Kalif Cox was arrested in February 2025, and the indictment with capital counts (alleged murder of a bystander) was filed March 2025. In addition to the murder, this multi-defendant indictment alleges the distribution of large quantities of drugs, sexual exploitation of a minor, receipt of child porn, and firearm distribution along with additional charges. A Notice of Intent was filed in a second DNM case, U.S. v. Babitz, Cr. 24-1284. This case had been scheduled for a DOJ meeting in July 2025, but the meeting was canceled, making this the second case authorized (NOI filed) without a DOJ meeting. The NOI can be found here.

The government has filed a notice of appeal from the decision and order of the trial court in U.S. v Gendron, Cr. 22-109 (WDNY) (DE 464) in which the trial court granted in part the defendant's motions to strike aggravating factors from the notice of intent, see notice of appeal here.
