December 11, 2025 - DOJ Activity Update

As of today, the Project is aware of  23 authorizations (2 of these with oral notification on record only, no NOI yet filed) here, and 42 post DOJ meeting no seek decisions,

On December 4, 2025, a notice of Intent to seek the death penalty was filed in U.S. v.  Kendrick Seymore, Cr. 22-401 (EDNY).  On 10/7/25, the government advised the court and counsel that it would seek the death penalty and would file the NOI within two weeks.  On 10/20/25 the government sought an extension to 12/15/25, but beat the extended deadline by 12 days.  The NOI is here.

On November 21, 2025, defense counsel filed a Motion to Strike the Government's Notice of Intent to Seek the Death Penalty in U.S. v. Shane Meehan, Cr. 22-00002 (SDIN).  This case was a prior Garland no seek in July 2022, and one of the cases reconsidered by AG Bondi and authorized.  The Bondi NOI was filed three years and four months after the government filed its formal notice of intent NOT TO SEEK the death penalty.  The motion, DE 175, is here.

On November 18, 2025, notices of Intent to seek the death penalty were filed in U.S. v. Theodore Bland, Cr. 24-99 (DVT), DE 226 (here) and U.S. v. Shane Meehan, Cr.

A Notice of Intent was filed in U.S. v. Edwin Flores Tavarez, Cr. 24-133 (DPR), DE 189, The DOJ meeting in this case was June 25, 2025.  The government did not seek against the co-defendant.  The NOI is here.

A Notice of Intent was filed in  U.S. v. Bryant Pirtle and Christopher Hall, Cr. 23-153 (EDMO), seeking death against both of the defendants, here.  For more information regarding AG Bondi's authorizations, including 4 oral notices with NOIs yet to be filed, see DOJ Activity tab.

Court Grants Motion for Partial Stay of Proceedings due to lapse in CJA funding and resulting impact on defense investigation. In U.S. v. Fawaz Ahemeid, Cr.

In U.S. v. Zachary Babitz, Cr. 24-1284 (DNM) the defense filed a Motion for Immediate Stay of Proceedings, which can be found here.  This case was authorized on 10/22/25 (DE 92).  The team had been invited to a DOJ meeting on 7/14/25, but the meeting was canceled by DOJ and not held.
